By accessing or using CDN BUNNY, you agree to these Terms, our Privacy Policy, and Acceptable Use Policy. If you use the service on behalf of an organization, you represent that you have authority to bind that organization.
1. The service
CDN BUNNY provides edge analytics, delivery tooling, and a private workspace for operators. Features may change. We may offer free and paid plans; paid features are described at purchase.
2. Eligibility
You must be at least 18 years old (or the age of majority in your province/state) and able to form a binding contract. The service is intended for business/professional use, not for children.
3. Accounts
You are responsible for safeguarding credentials and for activity under your account. Notify us promptly of unauthorized use. We may suspend accounts that pose security or legal risk.
4. Acceptable use
You must comply with our Acceptable Use Policy and all applicable U.S. and Canadian laws (including anti-spam, privacy, export, and intellectual property laws).
5. Customer content and data
You retain rights to content and data you upload. You grant us a limited license to host, process, transmit, and display that content solely to provide and secure the service. You represent you have all rights needed to use the service with that content.
6. Intellectual property
CDN BUNNY branding, software, documentation, and site materials are owned by us or our licensors. Except for rights expressly granted, no license is implied. You may not copy, modify, reverse engineer, or create derivative works of the service except to the extent such restriction is prohibited by applicable law.
7. Third-party services
Integrations (for example Cloudflare or Google fonts/tags) are subject to those providers’ terms. We are not responsible for third-party services we do not control.
8. Fees and taxes
If you purchase a paid plan, you agree to the fees and billing terms presented at checkout. Fees exclude applicable taxes (including U.S. sales tax and Canadian GST/HST/PST where required). See also our Refund Policy.
9. Disclaimers
TO THE MAXIMUM EXTENT PERMITTED BY LAW, THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE,” WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, OR STATUTORY, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. We do not warrant uninterrupted, error-free, or completely secure operation.
10. Limitation of liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, CDN BUNNY AND ITS AFFILIATES WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, REVENUE, DATA, OR GOODWILL. OUR AGGREGATE LIABILITY FOR ALL CLAIMS RELATING TO THE SERVICE WILL NOT EXCEED THE GREATER OF (A) AMOUNTS YOU PAID US FOR THE SERVICE IN THE 12 MONTHS BEFORE THE CLAIM OR (B) USD $100. Some jurisdictions (including certain Canadian provinces) do not allow certain limitations; in those cases our liability is limited to the maximum extent permitted.
11. Indemnity
You will defend and indemnify CDN BUNNY against claims arising from your content, your misuse of the service, or your violation of these Terms or law, except to the extent caused by our willful misconduct.
12. Suspension and termination
You may stop using the service at any time. We may suspend or terminate access for breach, legal risk, non-payment, or to protect the platform. Sections that by nature should survive (including IP, disclaimers, liability limits, indemnity, and governing law) will survive.
13. Governing law and disputes (U.S. and Canada)
Except where mandatory consumer protection law of your province or state requires otherwise:
- United States customers: These Terms are governed by the laws of the State of Delaware and applicable U.S. federal law, without regard to conflict-of-law rules. Courts located in Delaware have exclusive jurisdiction, subject to mandatory arbitration or small-claims rights where applicable.
- Canadian customers: These Terms are governed by the laws of the Province of Ontario and the federal laws of Canada applicable therein, and courts in Toronto, Ontario have exclusive jurisdiction, except that Quebec consumers retain mandatory rights under Quebec consumer protection law that cannot be waived.
Before filing a claim, contact [email protected] so we can try to resolve the dispute informally within 30 days.
14. Export and sanctions
You may not use the service in violation of U.S. or Canadian export control or sanctions laws.
15. Changes
We may update these Terms by posting a revised version. Continued use after the effective date constitutes acceptance, except where additional consent is required by law.
